Application process for 482 visa

Here are the four steps employers will need to pass through during the application process;

  • Employer applies to be a sponsor, usually takes a duration of one month
  • The employer must complete at least 4 weeks of labor market testing
  • The employer nominates employee
  • The employer applies for TSS visa, usually a period of 1-2 months

Employer eligibility

An employer is eligible to nominate an employee if it;

  • Is an approved standard business sponsor
  • Has a genuine position available
  • Conducts labor market testing to show that a suitable Australian worker is not available for the position, and
  • Will pay the annual market salary to the nominated employee.

Employee eligibility

An employee is eligible for the TSS visa if they;

  • They have been successfully nominated by approved employer for an occupation on one of the skills-list
  • Have worked in the nominated occupation for at least two years
  • Meet English language proficiency requirements
  • Have health insurance
  • Meet the health, character, visa history and genuine student statement.

Occupation eligibility

The nominated occupation must be one of the following;

  • Short-term skilled occupation list
  • Medium and long-term strategic skills list

2. Employer Sponsored ENS visa

The employer nominated ENS – subclass 186 visa is a permanent employer sponsored visa which allows employees to work for a nominated employer on a full-time basis.

Employees live and work in Australia, have access to Medicare, include family members and may and may eventually lead to citizenship.

The ENS visa allows you to work in Australia under one of two main streams.

a. The temporary residence transition stream (TRT Stream)

This stream allows you to transition from the temporary 457 or the new skills in demand visa.

  • Applicants must have worked in their nominated occupation for at least 2 years out of the last three years
  • Applicants can now access this pathway if their occupation is on the MTLSSL, STSOL and ROL occupation list.

b. The Direct Entry Stream

This stream allows you to apply directly for the permanent employer sponsored visa, to apply for this visa;

  • You occupation must be in the core skill occupation list or CSOL no longer MLTSSL
  • You have passed a skills assessment with relevant skills assessing authority
  • You must have worked in the occupation at the required skill level for at least three years.

3. Skilled Employer Sponsored Regional Visa Subclass 494 Visa

The skilled employer sponsored subclass 494 is a permanent visa that requires you to be nominated to work in a regional area. It’s a temporary visa that can lead to permanent residency.

It’ll replace the previous regional employer sponsored visa 187 (RSMS). The 494 visa is initially a temporary visa that may allow you to obtain permanent residency after three years.

Like all employer sponsored visas you must be nominated by an approved business sponsor to apply for this visa.

494 Visa holders;

  • Can move between jobs in a regional area, but will have 90 days to find a new nominator
  • Can access Medicare
  • Cannot apply for any other skilled PR or 820 partner visas for 3 years
  • Cannot apply for any other skilled PR or 820 partner visas for 3 years.

Sponsorship application

The business must apply for approval as a business sponsor by submitting a sponsorship application;

The employer must show;

  • The business is operating in a lawful manner
  • The business can meet its financial obligations
  • The business is devoted to training their staff

4. General Skilled Migration Visa

General skilled migration visa allows foreigners to migrate to Australia without having an employer sponsor their visa. To apply for general skilled visa, you must be skilled in an occupation that’s in demand in Australia.

Applicants are invited to apply for general skilled migration visas based on factors such as their occupation, work experience, education and English ability.
